What Is ISO 27001:2022 Annex A 6.2 – Terms and Conditions of Employment?

ISO 27001:2022 Annex A 6.2 discusses the need for a contractual agreement to inform any new employee of their and the company’s responsibility for information security.

This means employees should be familiar with the company’s information security policy and the roles and responsibilities of those who work in it. It is possible to achieve this by requiring personnel to sign an employment contract or some form of agreement.

In such a contract, the general requirements for protecting information assets are outlined, including physical security, environmental controls, access controls, contingency planning, and a confidentiality agreement if they will be working with personally identifiable information.

What Is The Purpose of ISO 27001:2022 Annex A 6.2?

The purpose of Annex A 6.2 is to ensure that all employees understand how they are responsible for protecting the company’s assets and confidential information in their role.

Obligations Under ISO 27001:2022 Annex A 6.2

ISO 27001:2022 Annex A 6.2 describes the terms and conditions of employment within your organisation’s information security management system (ISMS). It helps you comply with ISO 27001, GDPR and other legal requirements relating to the processing of personal data and information security.

To help achieve this, employees should be aware of their confidentiality obligations and other relevant terms and conditions before starting work. It may also include restrictions on using technology or social media.

Annex A 6.2 should be reviewed annually to ensure that any changes in organisational structure or procedures are reflected in employee documentation.

What’s Involved and How Do You Meet the Requirements of ISO 27001:2022 Annex 6.2?

An employment contract, or offer letter, which outlines all the terms & conditions of their employment, particularly in the area of information security, is the easiest way to comply with ISO 27001:2022 Annex A 6.2.

Contractual obligations for personnel should also take into account the organisation’s information security policy and relevant topic-specific policies. An employment contract should cover the following points:

  • Individuals who are given access to confidential information should sign confidentiality or nondisclosure agreements before getting access to the information assets.
  • A description of legal responsibilities and rights (e.g. copyright laws or data protection laws).
  • Responsibilities for the classification of information & management of the organisation’s information assets.
  • The information assets and other associated assets, information processing facilities and information services handled by the personnel.
  • The responsibility for handling information received from interested parties.
  • If personnel disregard organisational information security requirements, actions need to be taken and explained what they are.

In addition, the organisation should ensure that personnel agree to terms & conditions concerning information security.

What Are the Changes From ISO 27001:2013?

ISO 27001:2022 Annex A 6.2 replaces ISO 27001:2013 Annex A 7.1.2 (‘Terms and Conditions of Employment’).

There is no difference between the two versions apart from the change in Annex number. Although the phraseology of the two differs, the content and context are virtually the same.
